Heard counsel for the parties and perused the record.
Initially the petitioner was appointed on the post of Lamp Lighter in Nagar Palika Parishad, Aonla, district Bareilly in 1978.
It is alleged by him that now the work is being taken from him for the post of Line Man/Electrician. By letter dated 21.6.2005 the President of Nagar Palika Parishad, Aanla, district Bareilly has recommended that the designation of Lamp Lighter which has been declared as dying cadre be designated as Line Man/ Electrician and a direction in this regard may be taken from the State Government.
Though, the petitioner has an efficacious and alternative remedy before the Labour Court against his aforesaid grievance, he prays that his representation dated 22.3.2005 made in this regard before respondent no. 2 may be directed to be decided within a time frame fixed by this
Court. The counsel for the respondents has no objection to this prayer.
The writ petition is disposed of finally with a direction to respondent no. 2 to decide the aforesaid representation of the petitioner by a reasoned and speaking order, in accordance with law, within a period of six weeks from the date of production of a certified copy of this order.
The petitioner shall file a certified copy of this order before respondent no.2 within 15 days from today.
