Heard counsel for the parties and perused the record.
The counsel for the petitioner states that the value of the tickets can not be recovered from the employee until and unless it is proved by the department that those tickets have been mis-utilized and the department has in fact suffered loss due to such mis-utilization of the tickets. The petitioner has already submitted a representation dated 13.9.2005 in this regard before respondent no.2 and he has also replied to the show cause notice on 8.9.2005.
In the circumstances, the aforesaid representation of the petitioner may be decided within six weeks from the date of submission of a certified copy of this order by respondent no.2 by a reasoned and speaking order, in accordance with law. The authority is also directed to consider the reply of the petitioner to the show cause notice and pass appropriate orders within the same period.
The counsel for the petitioner has prayed that the recovery order may be stayed till the decision of the representation. The counsel for the respondents states that till the decision of the representation of the petitioner, no recovery shall be made from him, hence no order is required to be passed in this regard.
With the aforesaid observations, the writ petition is disposed of.
