Heard counsel for the parties and perused the record.
The case of the petitioner is that he was appointed on the post of Clerk on daily wages in Nagar Palika, Mughal Sarai, district Chandauli on 19.6.1991. The petitioner after completing 10 years regular service approached the respondents for regularization under the U.P. Regularization of Daily Wages Appointment on Group ''D' Posts Rules, 2001 on 20.6.2001 but no action was taken. It is stated that the petitioner has again moved a representation dated 17.8.2005 (Annexure-9 to the writ petition) before respondent no. 3 but to no avail.
The only prayer of the counsel for the petitioner at this stage is that a direction may be issued to the respondent no. 3 to decide the aforesaid representation of the petitioner dated 17.8.2005 within a time frame to which the standing counsel has no objection.
The writ petition is disposed of finally with a direction to respondent no.3 to decide the aforesaid representation of the petitioner by a reasoned and speaking order, in accordance with law within a period of two months from the date of production of a certified copy of this order.
The petitioner shall file a certified copy of this order before respondent no.3 within 3 weeks from today.
