1. The petitioner was granted mining lease on 21.11.1995 for ten years. This lease was cancelled on 25.7.1998. Subsequently this order was recalled vide order dated 30.5.2003 and the District Magistrate by order dated 11.6.2003 informed the petitioner that he can start mining lease again under the conditions mentioned in the letter. Thereafter the petitioner filed an application on 23.1.2005 before the respondent no.2 for for extension of the period of his lease for the period he was not permitted to work.
2. We have heard counsel for petitioner and Standing counsel for the respondents.
3. In the circumstances of the case, the petitioner may file a representation before respondent no. 2. In case the representation is filed, it may be decided by respondent no.2 by a speaking order, if possible, within three months from the date of receipt of the representation. The petitioner will file a certified copy of this order; necessary documents and a duly stamped self-addressed envelope along with his representation. Respondent no.2 after taking decision will communicate the same to the petitioner.
4. With these directions the writ petition is disposed of.
