Heard learned counsel for the applicants, learned AGA and perused the record.
It is contended by the learned counsel for the applicants that Renu is the daughter of applicant no.1. Renu filed an application under Section 125 Cr.P.C. on 24.9.2004 against the opposite party no.2 and on 27.11.2004 lodged an FIR under Section 498 IPC against the opposite party no.2 and certain others. The cases are pending for trial. The present complaint has been filed by the opposite party no.2 on 21.12.2004 in contrast to the above proceedings. In fact no occurrence took place as alleged in the complaint.
Considering the facts and circumstances of the case, issue notice to opposite party no.2 returnable within six weeks.
List on 19th December 2005.
Till then the further proceedings in complaint case no. 1689 of 2004 pending in the court of CJM, Jalaun at Orai shall remain suspended.
