The petitioner, defendant in suit, aggrieved by an order passed by the trial court on an application no.34A1 dated 1st August 2005, whereby the trial court allowed the application 34A1 filed by respondents and allowed the amendment and impleadment, approached the revisional court by means of Civil Revision which has been dismissed by the revisional court by order dated 23rd September 2005 holding that the impleadment and amendment, in the facts and circumstances of the case, cannot be said to be covered by the law laid down by the Supreme Court in the case of Bibi Zubaida Khatoon Vs. Bani Sassan Saheb and another reported in 2004 (1) CLR 1.
I do not find that the revisional court has committed any error in affirming the order passed by the trial court by the order passed in the revision. Thus has committed any error so as to warrant interference by this Court in exercise of jurisdiction under Article 226 of the Constitution of India.
This writ petition has, therefore, no force and is accordingly dismissed.
