Heard learned counsel for the applicants, learned Addl. Government Advocate for the State and perused the record.
It is contended by the learned counsel for the applicants that in compliance of the order dated 20.8.000 the custody of the property has been given in favour of petitioner no.2. The learned revisional court vide order dated 25.7.2005 has set aside the said order and remanded the matter back. The same is pending before the learned magistrate concerned.
Considering the facts and circumstances of the case, the learned magistrate concerned is hereby directed to proceed expeditiously with the proceedings and dispose of the same within a period of six weeks from the date of presentation of a certified copy of the order after providing opportunity of hearing to the parties concerned. Till then the custody of the property shall remain with the petitioner no.2.
With these observations, the application is disposed of.
