Heard Shri L.K. Pandey, learned counsel for the applicant and learned A.G.A. appearing for the State.
Learned counsel for the applicant has submitted that even in the case of dispute, pending enquiry, the vehicle must be given in his custody. He has relied on [2003 (46) ACC 223 (Supreme Court) Sunderbhai Ambalal Desai vs. State of Gujarat] which lays down that appropriate order should be passed immediately and it is not useful to keep the vehicle at the police station for a long period.
Considering this, it is hereby directed that vehicle Tata Indica no. U.P.78-AB/1079 be released in favour of applicant Yadunath Singh as a matter of interim custody during pendency of this application, on his furnishing a personal bond of Rs.1,50,000.00.
Notice be issued as ordered on 12.8.2005 and this case be listed in the first week of January 2006.
