Heard counsel for the parties and perused the record.
The case of the petitioner is that he was appointed on the post of Chaukidar on daily wages in Nagar Palika, Mughal Sarai, district Chandauli on 1.2.1989. The petitioner after completing 10 years regular service approached the respondents for his regularization under the U.P. Regularization of Daily Wages Appointment on Group ''D' Posts Rules, 2001 on 1.2.1999 but no action was taken. He has again moved a representation dated 8.8.2005 (Annexure-6 to the writ petition) before respondent no.3 but to no avail. Hence this writ petition.
Though the petitioner has an alternative remedy for redressal of his grievance before the Labour Court but he prefers that his representation dated 8.8.2005 may be directed to be decided by respondent no.3 within a time frame fixed by this Court. The standing counsel has no objection to this prayer.
The writ petition is disposed of finally with a direction to respondent no.3 to decide the aforesaid representation of the petitioner by a reasoned and speaking order, in accordance with law within a period of two months from the date of production of a certified copy of this order. If the petitioner is aggrieved by the decision of representation he may approach the Labour Court by raising an industrial dispute under the U.P. Industrial Disputes Act, 1947.
The petitioner shall file a certified copy of this order before respondent no.3 within 3 weeks from today.
