Petitioner who is employed as Sub Inspector of Police was transferred under an order dated 19.8.2004 to Mainpuri. On the request of the petitioner he was attached to Fatehgarh on the plea that the petitioner was undergoing treatment at District Hospital Fatehgarh. The said orderwas extended from time to time, according to the petitioner the last extension is valid up to February, 2006. From the records of the present writ petition it is apparently clear that the injury suffered by the petitioner is of the year 1990. It is further apparent from the records that the petitioner while posted at Hardoi in the year 2000had been visiting Fatehgarh for leading evidence in Criminal Case (paragraph 12 of the writ petition). By means of the impugned order petitioner has been relieved and he has been directed to work at the transferred place i.e. Mainpuri as per the order passed in the year 2004.
Counsel for the petitioner submits that the ailment suffered by the petitioner still continues, therefore, the order relieving the petitioner even prior to expiry of the term of the stay order is legally not justified.
I have heard learned counsel for the parties and gone through the records.
In the facts of the case no interference is called for against the order requiring the petitioner to comply with order of transfer which was issued in the year 2004. Petitioner has already been granted indulgence by the Police authorities for more than two years. No further indulgence is required.
Writ petition is devoid of merits and is accordingly dismissed.
