HIGH COURT OF JUDICATURE OF ALLAHABAD

Hon'ble Janardan Sahai, J.

       In the proceedings under Order 9 Rule 13 C.P.C. the Sub Divisional Magistrate passed an order of stay. Against that order the petitioner filed a revision before the Board of Revenue, which has been dismissed. The order passed by the Sub Divisional magistrate was a discretionary order. There is nothing to show that the discretion exercised is perverse and against the settled principles of law.

         The petition lacks merit and is dismissed.
