Heard learned counsel for the petitioner, learned Addl. Government Advocate for the State and perused the record.
The petitioner has not challenged the findings of the judgment recorded on merit with regard to the award of maintenance allowance, but has submitted that he is working as assistant driver in railway department and he is ready to deposit the entire amount of maintenance allowance, but some reasonable time be granted for this purpose, as he is at present not in a position to deposit the entire amount. But he is paying Rs.2000/- per month as maintenance allowance regularly to respondent concerned.
Considering the facts and circumstances of the case, the petitioner is permitted to deposit Rs.35,000/- as a part of arrears of maintenance allowance within a period of two weeks from today and the remaining arrears of maintenance allowance within six weeks thereafter i.e. half of the remaining arrears within two weeks and the remaining half within four weeks thereafter, but he shall continue to pay Rs.2000/- per month as maintenance allowance in this regard. The money shall be deposited with the court below and the court below shall release the said amount in favour of respondent no.2 Smt. Meera @ Geeta Dixit. In case of failure in complying with the order so passed, the court concerned shall initiate coercive measure to recover the amount forthwith.
The present petition stands disposed of accordingly.
