Revisionists Sita Ram, Ram Pal and Chhetar Singh were convicted by order dated 5.9.1984 to undergo sentence of three months R.I. and Rs. 200/- as fine under Section 323 I.P.C. and six months R.I. and Rs. 500/- fine under Section 452 I.P.C. The appeal against the said judgement was dismissed by the Additional Sessions Judge, Moradabad by order dated 18.2.1985.
The learned counsel for the revisionists has not made any submission on the merit of the case but has advanced argument only about the quantum of the sentence. The matter relates to the year 1982 and sentence was passed in 1984. More than 22 years have elapsed since then. The offence is also of trivial nature.
Considering this, the revision is dismissed and conviction under section 323 I.P.C and section 452 I.P.C. is maintained. The sentence is, however, modified and in place of imprisonment, the revisionists shall pay a fine of Rs. 10,000/- for the above sentences out of which, Rs. 6000/- shall be paid to injured Yeshpal, Bhopal and Smt. Sankariya at the rate of Rs. 2000/- each and remaining Rs 4000/- shall be deposited in favour of State.
During the pendency of this revision, revisionists Sita Ram and Chhetar Singh have died, hence Rs. 10,000/- amount of fine shall be paid by the revisionist Rampal within 45 days from the date of production of a certified copy of this order. In case of default revisionist Rampal shall undergo simple imprisonment of six months.
