This writ petition has been filed raising the grievance that the petitioner's vehicle has been seized by the police/transport authorities in exercise of power under Section 207 of the Motor Vehicles Act, 1988 as the petitioner could not afford to deposit the outstanding dues.

After hearing Shri A.R. Dube, learned counsel for the petitioner and Shri A.N. Shukla, learned standing counsel for the State, we dispose of this writ petition directing the Assistant Regional Transport Officer (Enforcement), Ballia that in case the petitioner deposits 1/3rd of the outstanding dues and undertakes two montly instalments, the vehicle may be released in favour of the petitioner on deposit of the first instalment.
