Heard learned counsel for the accused-applicant, learned Addl. Government Advocate for the State and perused the record.
It is contended by the learned counsel for the accused applicant that the accused applicant has opened fire upon the police party but no one sustained injury and an Italian pistol alleged to have been recovered wherein he has already been released on bail.
Considering the facts and circumstances of the case but without expressing any opinion on the merit of the case, it appears proper that the accused applicant be released on bail.
Let applicant Alok Singh alias Pintoo involved in Case Crime no. 350 of 2005 under Section 307 IPC P.S. Vardah Distt. Azamgarh shall be released on bail on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
