According to the record before us, it appears that a joint written statement of defendants No. 1 to 4 and defendants No. 6 to 10 has been filed. Apparently, the Court has fixed 17th October 2005 for written statements of defendant No. 11 and issues. The suit is for partition.
The petitioners want that the trial Court be directed to decide the civil suit within six months. This kind of an order can not be passed fixing any time frame for decision of suits without reference to other cases, which may be pending on the Board of the trial Court and which may be older or more urgent.
Just because the petitioners have chosen to file a writ petition, the Court is not bound to issue this kind of a time frame for trial Courts.
In the circumstances, we only direct the trial Court to proceed with the trial of the suit expeditiously without granting undue or unduly long adjournments in the matter but having due regard to other cases, which may be pending before the Court and which may be older or more urgent.
This writ petition is disposed of as above.
