Heard Sri Rohit Pandey Advocate on behalf of the petitioner and Sri Neeraj Tiwari, Advocate on behalf of Chhatrapati Shahu Ji Mahraj University, Kanpur.

The petitioner who has appeared as a candidate in the examination conducted by the Chhatrapati Shahu Ji Mahraj University, has filed this writ petition against the order passed by the Assistant Registrar (Confidential) whereby the result of the petitioner has been cancelled on the charge of use of unfair means.

It is contended on behalf of the petitioner that the aforesaid orders are based on incorrect facts inasmuch as the petitioner was not involved in the use of unfair means. It is further submitted that the order passed by the Assistant Registrar (Confidential) is legally not sustainable in the eye of law.

On behalf of the University it is contended by Sri Neeraj Tiwari that the petitioner may make a representation before the Registrar of the University. The Registrar shall pass a reasoned speaking order, if the representation is so made by the petitioner.

In view of the facts and circumstances noticed hereinabove this writ petition is disposed of with a direction that the petitioner may make a detailed representation to the Registrar of the University ventilating all his grievances. On such representation being made the Registrar shall call for the relevant records and after examining the same shall pass a  reasoned speaking order within six weeks from the date the representation is so made by the petitioner.
