Admittedly, against the order impugned in the present writ petition, statutory appeal under Rule 20 of the U.P. Police Officers of Subordinate Rank (Punishment and Appeal) Rules, 1991 has been provided for.
Writ petition is, accordingly, dismissed on the ground of availability of of statutory alternative remedy.
However, in the facts and circumstances of the case, it is provided that in case the petitioner files an appeal within three weeks from today along with certified copy of this order, the Appellate Authority shall entertain the same without raising any objection with regards to delay in filing of the appeal and shall endeavour to decide the appeal at the earliest possible, preferably within four weeks thereafter. The Appellate Authority shall pass a reasoned speaking order.
