Heard Sri R. K. Saini, learned counsel for the accused applicant, learned A.G.A. and perused the record.
Learned counsel for the accused applicant has contended that learned Magistrate has erred in directing that the application filed under Section 156(3) Cr.P.C. be treated as complaint. He also fixed a dated for statement of the complainant under Section 200 Cr.P.C. If the applcaiton under Section 156(3) Cr.P.C. is filed learned Magistrate can either direct for registration of the case or dismiss it or can direct to treat it as complaint under Section 200 Cr.P.C. There is no illegality in the impugned order and the application is devoid of any merit and is liable to be dismissed.
Application is hereby dismissed.
