       Heard counsel for the parties and perused the record.

       The father of the petitioner died in harness on 29.9.2004. He was a permanent employee of Kashimpur Power House and was working on the post of Labour.

        The counsel for the petitioner has urged that a Succession certificate has been issued in favour of the petitioner and that after the death of his father the petitioner has made an application to the Executive Engineer Vidyut Khand-II requesting that he may be appointed on compassionate ground under the U.P. Rajya Vidyut Parishad Sewakar Ke Mrit Parishadiya Sewako Ke Ashrito Ki Bharti Niyamawali,1975.

          It has been informed that the petitioner as well as respondent no.4 who is also son of the deceased employee have made applications for compassionate appointment under the aforesaid Dying in Harness Rules before respondent no. 3.

           The only prayer of the counsel for the petitioner at this stage is that the application of the petitioner as well as application of respondent no. 4 may be directed to be decided by respondent no. 3 within a time frame fixed by this Court.

            The standing counsel has no objection to this prayer.

          In the circumstances, the petition is disposed of finally with a direction to respondent no.3 to decide the aforesaid matter by a reasoned and speaking order, in accordance with law within a period of six weeks from the date of submission of a certified copy of this order.

     The petitioner shall file a certified copy of this order before respondent no.3 within 15 days from today.
