Shri Umesh Sharma, learned Senior counsel has stated that he is not pressing the reliefs (i) to (iv) made in the writ petition. Shri Sharfuddin Ahmad, instructing counsel is directed to delete the aforesaid reliefs.
However, by way of an application filed under Order 6 Rule 17 of the Code of Civil Procedure, the petitioner seeks to incorporate the following relief, mentioned in paragraph 4 of the affidavit, filed by Shri Shailendra Singh Gautam in support of the amendment application.
(i) issue a writ, order or direction in the nature of mandamus commanding upon the respondents to inquire into the alleged bungling committed during the election of Ward No. 18 Zila Panchayat Kanpur Nagar and take suitable action against them.
The application is allowed. Let the amendment be incorporated within three days.
Shri K.P. Singh, who represents the respondent No. 2 prays for and is granted three weeks time to obtain instructions and to file counter affidavit. Rejoinder may be filed within one week.
