Heard learned counsel for the petitioner, learned Addl. Government Advocate for the State and perused the record.
Issue notice to respondent no.2 returnable within four weeks.
List on 02nd January 2006.
Till then the remaining arrears of maintenance allowance @ Rs.1500/- per month payable from the date of application i.e. 5.3.2002 shall remain stayed, provided the petitioner deposits a part of its arrear at the same rate for a year within two weeks from today with the court below and shall continue to pa Rs.1500/- per month as maintenance allowance to the respondent concerned. The money shall be deposited with the court below and the same shall be released in favour of the respondent concerned. In case of failure, the court concerned shall initiate process to recover the amount. If any amount of maintenance has already been deposited by the petitioner, that shall be adjusted in the amount as per order of this court.
