Heard Sri S.N.Singh, learned counsel for the petitioner, Sri Anshu Chaudhary, learned counsel for the respondent (Smt.Kamani Devi), learned Addl. Government Advocate for the State and perused the record.
Learned counsel for the respondent prays for and is granted three weeks' time to file counter affidavit. Rejoinder affidavit, if any, may be filed within a week thereafter.
List on 3rd of January 2006.
As per contention of the learned counsel for the petitioner, he has deposited 1/3rd of the maintenance allowance i.e. Rs.53,000/- and is ready to deposit some more from the date of oder. In case the petitioner deposits Rs.25,000/- within two weeks from today and continues to pay Rs. 3500/- per month as maintenance allowance to the respondent concerned, the remaining arrears of the maintenance allowance from the date of application i.e. 5.8.2002 shall remain stayed. The money shall be deposited with the court below and the same shall be released in favour of the respondent concerned. In case of failure, the court concerned shall initiate process to recover the amount.
