In the facts and circumstances of the case, the proper remedy available to petitioner is to approach Central Administrative Tribunal at the first instance in view of the judgment of the Hon'ble Supreme Court in the case of L. Chandra Kumar vs. Union of India and others, reported in (1997) 3 SCC 261.
In view of the aforesaid, writ petition is dismissed with liberty to petitioner to seek appropriate remedy before the Central Administrative Tribunal.
