Heard Sri A. R. Singh, learned counsel for the applicants, learned A.G.A. and perused the record.
Learned counsel for the applicants has prayed for cancellation of the charge sheet in Criminal Case NO. 1164 of 2005 under Sections 323, 504, 506 IPC and Section 3(1)(X) of SC/ST Act, pending before the Civil Judge, Junior Division, Saidpur, District Ghazipur.
The allegations as made against the applicants are that they addressed the complainant that caste denoting word and also abused and beat him.
Learned counsel for the accused applicants has further contended that no offence under Section 3(1)(10) SC/ST Act is made out. But the allegation as made in the report and the statement of the witnesses show that there are prima facie allegation against the applicants. He has prayed that learned Trial Court be directed to decide the bail application of the applicants same day.
Considering the facts and circumstances of the case, application is finally disposed of with the direction that if the applicants surrender before the concerned Court in the above noted case crime within 15 days from today and pray for bail, the same be considered and decided according to law as laid down in the case of Amrawati Vs. State 2004 (57) ALR 390 expeditiously.
