Pancham v. D.M. Maharajganj & Others. - WRIT - C No. 27635 of 2004 RD-AH 619 (3 March 2005)
Hon'ble Amitava Lala,J.
Hon'ble Sanjay Misra,J.
The authority concerned has come to an appropriate conclusion in black listing the petitioner from the contractor-ship of the relevant job. The petitioner, in fact, is asking relief not to give effect to the impugned order in connection with acceptance of tender and giving opportunity of hearing to satisfy the authority why he should not be black listed because it is touched of the credibility of the contractor. Having so, we are of the view that such question can only be decided by passing a reasoned order upon giving fullest opportunity of hearing by the authority concerned within a period of one month from the date of communication of this order. However, if any tender is floated, the petitioner may take opportunity but acceptance and non acceptance will entirely be in the hands of the respondents.
Thus, the writ petition stands disposed of.
However, no order is passed as to cost.
