HIGH COURT OF JUDICATURE OF ALLAHABAD

Hon'ble Yatindra Singh,J.

Hon'ble R.K.Rastogi,J.

This is a writ petition against order dated 9.11.2005 passed by the State Government  directing that the lease money should not be reduced.

We have heard counsel for the petitioner and the Standing counsel for the respondents.

By the impugned order the State Government directed that it is not proper to reduce lease amount which was earlier fixed and in case  the lease has been approved in favour of some one and he is not in a position to pay the amount  then the plots  may be readvertised. There is no justification to interfere with the said order.  However, in case the plots are  advertised,  then it will be open to the petitioner to apply again.

With these  observations the writ petition is dismissed.
