The petitioner was never elected and no certificate to that effect has been issued to the petitioner. The solitary certificate has been issued in favour of the contesting respondent.

The petitioner has alternative remedy to file election petition and in view of Article 243(O) of the Constitution which says that not with standing anything contained in the Constitution which also includes Article 226 the election cannot be challenged except by way of an election petition.

We accordingly decline to interfere in this petition. Petition is dismissed.
