In response to our earlier order dated 21/9/2005, two affidavits have been filed by the learned Chief Standing Counsel Shri C.B. Yadav and he has appeared along with Shri C.K. Rai, learned Standing Counsel. It is evident from the said affidavits that a sum of Rs. 5,19,266/- remains outstanding of the petitioner which is payable with ten percent interest, which comes to Rs. 1,77,415.80 Paise. Out of the said amount the principle amount i.e. Rs. 2,57,180/- and Rs. 2,62,86/- equivalent to Rs. 5,19,266/- has already been paid. Photo copies of the receipts have been produced before us. However, it is not evident from the said affidavits as to whether the amount of interest to the tune of Rs. 1, 77, 415.80 paise has been paid to the petitioner or not.

Shri Yadav has submitted that if the interest has not already been paid, under all circumstances it shall be paid to the petitioner within a period of thirty days from today.

In view of the assurance given by Shri C.B. Yadav, we do not want to keep the petition pending and proceed further.

The writ petition stands disposed of with the observation that in case the interest amount is not paid within a period of thirty days, the petitioner shall be entitled to initiate contempt proceedings against the respondents.
