Heard counsel for the parties and perused the record. With the consent of counsel for the parties, the case is being decided at the admission stage itsef.
The case of the petitioner is that he was appointed as Tracer on 15.10.1973. He claims that he is entitled to time scale of Rs.530.-810 w.e.f. 15.10.1982 after completion of 9 years of service. Despite several representations, no heed is being paid by the respondents and hence this petition.
Though the petitioner has an alternative remedy under Section 6-H(2) of the U.P. Industrial Disputes Act but the only prayer of counsel for the petitioner, is that the representation of the petitioner dated 13.6.2005, Annexure 10 to the petition, be directed to be decided by respondent no. 2 within some time frame to which counsel for the respondents has no objection.
Accordingly, the writ petition is disposed of with the direction to the respondent no. 2 to decide the representation dated 13.6..2005 of the petitioner, contained in Annexure 10 to the writ petition, by a reasoned and speaking order in accordance with law within a month from the date of production of a certified copy of this order together with a copy of the representation. No order as to costs.
