Rajesh Kumar And Another v. State Of U.P. And Others - WRIT - C No. 72400 of 2005 RD-AH 6435 (25 November 2005)
Hon'ble Yatindra Singh,J.
According to the petitioners, a lease has been approved in their favour but it has not been executed, hence the present writ petition.
We have heard counsel for the petitioner and the Standing counsel for the respondents.
In the circumstances of the case, it will be appropriate that the petitioners may file a fresh representation before respondent no.2. In case the representation is filed, the same may be decided by the said respondent by a reasoned order at an early date, if possible, within one month from the date of receipt of the representation. The petitioners will file a certified copy of this order; necessary documents and a duly stamped self addressed envelope along with the representation. The concerned authority after taking decision will communicate the same to the petitioners.
The respondent no.2 while passing order on the petitioners' representation will also consider any interim or final order if it has been passed in favour of Pankaj Kumar Singh in the revision filed by him before the State Government.
With these observations the writ petition is disposed of.
