Heard learned counsel for the petitioner, learned Addl. Government Advocate for the State and perused the record.
Issue notice to respondent no.2 returnable within four weeks.
List on 09th of January 2006.
Till then the remaining arrears of maintenance allowance @ Rs.700/- per month payable from the date of application i.e. 24.6.2003 shall remain suspended, provided the petitioner deposits a part of its arrear i.e. for a period of six months at the same rate within two weeks from today and shall continue to pay Rs.700/- per month as maintenance allowance from the date of order i.e. 11.8.2003. The money shall be deposited with the court below and the same shall be released to the respondent concerned forthwith. In case of failure, the court concerned shall initiate process to recover the amount.
