Original records were summoned from Consolidation department.
A mention was made on behalf of learned counsel for petitioner for adjournment of the case.
Learned Standing Counsel states that the officials of the Consolidation department are present today alongwith the original records and, therefore, the case may not be adjourned. He further urged that in any case if the case is adjourned today, some other date may be fixed.
In the facts mentioned above, it is directed that the learned Standing Counsel may peruse the original records personally and file a Supplementary Counter Affidavit of the concerned official on following facts:-
(1) Whether there is any order available on record passed by the Consolidation authorities incorporated in the concerned Khatauni and in case it is available, certified copy of the same shall be filed alongwith the Supplementary Counter Affidavit;
(2) In case any order is not available, learned Standing Counsel shall file details of the Plots directed to be recorded in the names of respective tenureholders and also basis of their title after enactment of U.P. Zamindari Abolition & Land Reforms Act as regards those plots available on record.
