Smt. Punam Kulshrestha And Others v. State Of U.P. And Others - WRIT - C No. 73420 of 2005 RD-AH 6761 (1 December 2005)
Hon'ble R.K.Agrawal, J.
Hon'ble Saroj Bala, J
Smt. Punam Kulshrestha, petitioner No. 1 and Shri Prem Singh, petitioner No. 2 are present in the Court at the time of taking up of the writ petition and have been identified by their counsel Shri Sanjeev Kumar Pandey.
According to the High School Certificates, (filed as Annexure Nos. 1 and 2), both are major. Their contention is that they have married according to Hindu Customs and are living together for which an agreement on a Stamp Paper of Rs.20/- has also been executed before the Notary Public on 7.7.05.
The allegation is that the respondent Nos. 4 & 5 with the help of the Respondent Nos. 2 & 3 are unnecessary interfering in their peaceful living.
Without going into the question as to whether the petitioners have married or not, as both of them as per the High School Certificate are major and according to their own showing, they are living together, the writ petition is disposed of with the direction to the respondent Nos. 2 to 5 not to interfere in their peaceful living unless they are required in some pending criminal investigation or case or F.I.R. lodged or any case is pending before any authority or any court of law.
