Heard Sri Mangal Prasad Rai, learned counsel for the accused applicant, Sri  Santosh Dwivedi, learned counsel for the opposite party no. 2, learned A.G.A. and perused the record.

The contention of the learned counsel for the accused applicant is that opposite party no. 2 has filed a false report against  applicant alleging that she has forged her degree and mark sheet.

Applicant is presently working as lecturer in Intermediate College. The contention of the learned counsel for the accused applicant is that the mother of opposite party no. 2 is also working as lecturer and there is dispute between them regardin seniority and the same is pending in this Court. The contention of the learned counsel for the opposite party is that in this matter an enquiry was made by Smt. Malti Rai, the then D.I.O.S., Varanasi and she has given a finding that the applicant has manipulated her appointment and promotion. But according to the learned counsel for the accused applicant there is no finding about the forged mark sheets or degrees as alleged in the F.I.R. The opposite party shall file a detailed counter affidavit in the matter within four weeks. Thereafter applicant shall file rejoinder affidavit within one week. The case be listed for hearing on 27.1.2006. Till then no coercive steps shall be taken against the applicant in Criminal Case No. 489 of 2004 under Sections 420, 467, 468, 471, IPC pending in the Court of J.M. Court No. II, Varanasi.
