During course of the argument learned counsel for the petitioner comes up with the prayer that instead of entering into merits in respect to the recovery proceedings if this petition is disposed of by giving direction to the concerned bank to decide petitioner's application for giving benefit of one time settlement scheme within a reasonable time, petitioner may get justice.

In view of the aforesaid this court proposes to dispose of this writ petition by allowing relief as noted above.

Respondent bank is directed to decide petitioner's application for grant of one time settlement scheme benefit, in accordance with law, if that application is still pending, preferably within a period of one month from the date of receipt of certified copy of this order. It is made clear that this court has not examined the merits of the matter in respect to correctness, incorrectness in the recovery proceeding. It is further made clear that if petitioner claim/application in respect to one time settlement scheme benefit has already been disposed of and any decision has already been taken then respondent bank need not to take up the matter again. In the event of disposal of petitioner's application, as stated before this court during course of the argument entire amount will be paid by the petitioner within the time so allowed by the  respondent bank.

With the aforesaid direction, this writ petition stands disposed of.
