Afsar Ahmad & Another v. Zila Panchayat Etah Thru' President & Another - WRIT - C No. 47387 of 2003 RD-AH 692 (10 March 2005)
Hon'ble Amitava Lala, J.
Hon'ble Sanjay Misra, J.
The petitioners contended that they were running slaughtering house under appropriate licence of the authority concerned, which was expired on 31st March, 2003. But the same was not renewed in spite of making application and depositing the fees for the purpose of renewal of licence.
No body appeared on behalf of respondents nor any counter affidavit has been filed. We find from the photocopy of the licence that certain rules are to be followed in carrying out such licence. The writ petitioners are interested for disposal of the writ by giving direction upon the authority concerned to consider their representation.
Having heard the learned Counsel appearing for the petitioners we are of the view that the writ petition can be disposed of and accordingly is disposed of hereunder with a direction upon the appropriate authority to consider the representation in accordance with law upon giving fullest opportunity of hearing and by passing a reasoned order thereon within a period of two months from the date of communication of this order. At the time of considering the matter the authority concerned will be much careful about the applicability of relevant rule/sub-rule/administrative order/circulars, etc. and also local religious problem, if any.
Thus, the writ petition is disposed of.
No order is passed as to cost.
