This petition is directed against the judgment and order dated 20.4.2005 passed by the Central Administrative Tribunal, Allahabad Bench, Allahabad.
Respondent No.1 Ram Bachan Singh had filed Original Application No. 1216 of 2001 before the aforesaid Tribunal for setting aside the order dated 17.10.2001 passed by the Appellate Authority by which his request for correction of the date of birth was rejected. From the records it transpires that the date of birth of the applicant/respondent No.1 was recorded as 1.11.1943 in the Service Book when the applicant joined the Organization in 1962. Subsequently the said date was struck off in the Service Book in red ink and substituted by 1.11.1941. The Tribunal by the impugned judgment and order has recorded a categorical finding of fact that the date of birth of the applicant was recorded as 1.11.1943 in the High School Certificate issued by the U.P. Board and so there was no doubt that the date of birth of the applicant was 1.11.1943, which had been recorded in the Service Book at the time when the applicant joined the service.
We have carefully perused the judgment under challenge and heard Sri K.C. Sinha, learned Assistant Solicitor General of India and have examined the other materials available on record.
Learned counsel for the petitioners has not been able to point out as to why the date of birth, which was initially recorded as 1.11.1943 in the Service Book was deleted with red ink without any signatures and was substituted by 1.11.1941 particularly when the date of birth entered in the High School Certificate was 1.11.1943.
Such being the position, there is no infirmity in the judgment and order of the Tribunal. The writ petition is, accordingly, dismissed.
