In the order impugned itself it is provided that if the petitioner is not satisfied with the order rejecting disability pension he may prefer an Appeal within six months from 26.5.2005 in triplicate through records office.
There is a dispute with regard the authority before whom the Appeal is to be filed against the order dated 9.3.2005. However, counsel for the respondents Shri K.C.Sinha pointed out that in view of the head quarter letter dated 18.8.2005 second Appeal against an order refusing to grant disability pension is to be heard and decided by the Army Head Quarters.
In view of the aforesaid statement made by Shri K.C.Sinha with rereference to the head quarter letter dated 18.8.2005 it is provided that the petitioner may file his Appeal in triplicate before the Chief Records Officer (respondent no. 3 ) within three weeks from today along with certified copy of this order. On receipt of the Memo of Appeal, the Chief Records Officer, respondent no. 3 shall transmit the same for decision to the Army Headquarters in accordance with letter dated 18.8.2005. The Appellate Authority shall decide the appeal within eight weeks from the date appeal is so transmitted. With the above direction the writ petition is disposed of.
