Smt. Sundari Devi And Another v. Union Of India And Others - WRIT - A No. 74037 of 2005 RD-AH 7037 (6 December 2005)
Hon. Dr. B.S. Chauhan, J.
Hon. Dilip Gupta, J.
List revised. None present for the petitioners. Sri K.C. Sinha, learned Assistant Solicitor General of India appears for the respondents.
The case relates to the appointment on compassionate ground and in the instant case the petitioners' claim has been rejected by the Tribunal on the ground that appointment in the said quota is available to the extent of 5% of the direct recruitment and for that purpose applications of all the applicants had been considered together. The case of the petitioners was also considered. However, the other candidates were more meritorious and, therefore, the petitioner No. 2 could not get the appointment.
There has been an extraordinary delay for which the petitioners are responsible as the papers asked by the respondents had not been supplied in time rather they have been submitted in piecemeal.
In view of the above, we do not see any reason to interfere with the well-reasoned judgment and order of the Tribunal.
The writ petition stands dismissed.
