This writ petition has been filed raising the grievance that the appeal filed by the petitioner against the order rejecting the claim under an Insurance Policy is not being decided. The petitioner's father had three Insurance Policies and after his death on 6th June, 2003 though the payment in respect of the two policies was made but the claim in respect of the 3rd policy was rejected. The petitioner had filed an appeal against the said order.
Sri Prakash Padia, learned counsel appearing for the respondent-Corporation has assured the Court that the appeal shall be disposed of strictly in accordance with law as early as possible.
In view of the above, we dispose of this writ petition requesting the learned Appellate Authority, respondent no.1 to decide the appeal of the petitioner strictly in accordance with law as early as possible preferably within a period of three months from the date a certified copy of the order is placed before it and in case the appeal is allowed than the payment should be made within a period of six weeks thereafter.
