The petitioner's Fair Price Shop licence was suspended by the order dated 15.5.2005 but no show cause notice has yet been served upon the petitioner. The impugned order is based upon an enquiry report dated 16th May 2005.
In the circumstances, we direct that if no show cause notice has been given to the petitioner, the show cause notice will be given within 10 days of the date on which certified copy of this order is presented before the respondent No. 2. The show cause notice will enclose a copy of the complaint as well as a copy of the enquiry report dated 16th May 2005. The appropriate final reasoned orders will be passed by the respondent No. 2 in the matter within one month of the date on which the petitioner submits reply to the show cause notice.
The writ petition is disposed of with the aforesaid directions.
