1. One Vijay Lal Bind had taken loan from Union Bank of India. The petitioners were guarantors of the said loan. The borrower could not pay the same and recovery proceedings were started. The borrower filed fist writ petition namely WP No. 1510 of 2001 which was disposed of on 15.1.2001 with the observations that the payment may be made in instalment. The borrower filed second writ petition no. 21978 of 2001 which was disposed of on 6.6.2001 with the observations that the petitioner may file representation before the Bank and thereafter recovery proceeding started against the guarantor, hence the present writ petition.
2. We have heard Counsel for the petitioner, the Standing Counsel and Sri Sachindra Mohan, counsel for the respondents. The counsel for the petitioner submitted that borrower has paid the entire money and nothing is due. The petitioner, if he is so advised, may file a suit. With these observations the writ petition is dismissed.
