Petitioner is permitted to make necessary corrections in the array of parties during the course of the day.
Heard Sri N.N. Mishra, learned counsel for the petitioner and learned Standing Counsel for the respondents.
It is contended on behalf of the petitioner that the petitioner, who was appointed as Class-IV employee in the Tube-well department of the State of Uttar Pradesh on compassionate ground in the year 1994, has actually discharged his duties referable to the post of Clerk. Therefore, the Executive Engineer, Tube-well Khand, District Siddhartha Nagar had recommended for temporary promotion being granted to the petitioner on Class-III post. The reference so made is pending consideration before the Superintendent Engineer, Tube-well Department, Siddhartha Nagar (respondent no.3). Hence the present writ petition.
In the facts and circumstances of the case, the present writ petition is disposed of finally with a direction upon the respondent no.3 to take a decision with regard to the relief prayed for by the petitioner, strictly in accordance with law and rules applicable, by means of a reasoned speaking order, preferably within six weeks, from the date a certified copy of this order is filed before the respondent no.3.
With the above observations, the writ petition is disposed of finally.
