Heard Sri Siddarth Varma learned counsel for the petitioner and the learned standing counsel.
Learned counsel submits that the petitioner was appointed as Lecturer on ad hoc basis on 25.7.1990 in Mahabodhi Intermediate College, Sarnath, District Varanasi. At the first, the petitioner made prayer that the services of the petitioner be deemed to be regularized under the amended provision of section 33-B of the U.P. Secondary Education Service Selection Board, 1982. Later on the learned standing counsel submitted that provisions of section 33-B does not grant to the petitioner any deemed regularization. The submission made by the learned standing counsel is correct. The section merely provides that in case a person has been appointed as an ad hoc teacher before the cut of date i.e. 14.5.1991, he shall become eligible for consideration of being regularized.
In view of the above submissions, I am of the opinion that the petitioner is indeed eligible for being considered for regularization under section 33-B (1) of the Act.
I therefore direct the respondent authority to consider the petitioner for regularization as Lecturer under section 33-B (1) of the U.P. Secondary Education Service Selection Board Act. Petitioner shall make a representation for regularization within a period of one month from the date of issuance of certified copy of this order to the respondent authority, who shall consider the same within three months thereafter.
With these directions, the petitioner is finally disposed of.
