Heard learned counsel for the petitioner and the learned standing counsel.
It is alleged that the impugned award was made in favour of the respondent workman, by which he was granted Specialist Grade I. When the writ petition was filed, no interim order was granted to the petitioner. Under the award the respondent workman remained so and continued to receive the benefits of the award.
Sri V.K. Barman learned counsel for the respondent workman informs the court that the workman has since long retired and he has already received the benefits under the award. He has also argued that even otherwise the present writ petition is concluded by findings of fact, which cannot be assailed in writ jurisdiction.
The writ petition is dismissed. There will be no order as to costs.
