Counsel for the petitioner has fairly stated that he may be granted liberty to file an appeal before the authority, as directed under the orders of the Inspector General of Police (P.A.C.), Madhya Zone, U.P. dated 28.7.2005 and the Appellate Authority in turn may be directed to decide the appeal in a time bound manner inasmuch as the petitioner is due to retire within a short span of 8 months.
In the facts and circumstances of the case, it is provided that in case petitioner files an appeal before the competent authority in pursuance of the order of the Inspector General of Police (P.A.C.) Madhya Zone, U.P. Lucknow dated 28.7.2005 within one week from today along with certified copy of this order. The Appellate Authority shall entertain the same without raising any objection with regards to delay, if any, in filing of the appeal and shall decide the same on merits by means of a reasoned speaking order, preferably within four weeks from the date the appeal is so filed.
Writ petition is disposed of.
