The petitioners have challenged the order of Board of Revenue dated 16.3.2005 by which the Board of Revenue has set aside the Commissioner's order and has maintained the order of the Additional Collector for expunging the entry in the revenue record on the ground that they are farzi. It is submitted by the petitioners' counsel that the order is an exparte one without notice to the petitioners. He concedes that an application for restoration was filed by the petitioners which is pending before the Board of Revenue. As the petitioners have, and are pursuing, an alternative remedy it is not a fit case for interference at this stage. The Board of Revenue shall try to dispose of the restoration application expeditiously. With these observations the petition is dismissed.
