HIGH COURT OF JUDICATURE OF ALLAHABAD

HON. SHISHIR KUMAR, J.

By means of the present writ petition the petitioner has approached this Court for issuing a writ of mandamus directing the respondents to consider the case of the petitioner for regularization. It has been submitted by the petitioner that the petitioner was appointed on 1.6.1994 as part time sweeper in the office of respondent no.2. It has been submitted that in 2000 an administrative instruction was issued for the purpose of conversion of part time casual labourers working for less than 4 hours per day into full time. The petitioner made an application to the District Magistrate for regularization. It has also been submitted that a list of part time workers has been prepared by the respondent in which the name of the petitioner is shown at serial no. 2. Instead of recommending the name of the petitioner, the name of Smt. Ram Kali whose name appears at serial no.5 has been recommended. The petitioner also annexed a document showing therein that the name has been recommended for regularization. It has further been submitted by the petitioner that instead of full time salary now the respondents are not paying the salary for holidays and Sundays. Further submission of the petitioner is that she has submitted a representation to this effect to the relevant authority.

After hearing counsel for the parties, the present writ petition is disposed of with a direction to respondent no.2 to consider the case of the petitioner on the basis of the representation filed by her. Respondent no.2 shall pass a detailed and reasoned order according to law preferably within 3 months from the date of production of a certified copy of this order before him.

With these observations the writ petition is disposed of.
