The controversy involved in this petition lies in a very narrow compass as the grievance of the petitioner is that he is a Block Pramukh and the Block Development Officer, Block Gonda, the respondent no.3 is not making signatures on cheques as per the requirement of Section 101-A of the U.P. Kshetra Panchayat and Zila Panchayat Adhiniyam, 1961. As per the aforesaid provision, the withdrawal of money can be made by joint signatures of Block Pramukh and the Block Development Officer. Petitioner claims that as the respondent no.3 is not cooperating, all the developmental works have come to a standstill and, therefore, this Court should issue directions to the respondent no.5 to cooperate with the petitioner.
On 15.12.2005, learned Standing Counsel was given time to seek instructions. However, no instruction has been furnished to him.
In this fact situation, we direct the respondent no.2, the District Magistrate, Aligarh to examine the whole issue and issue necessary instructions to the respondent no.5 to cooperate with the petitioner and he should not create any hurdle or hindrance in the development of the area and if he is satisfied that the work has been done in accordance with law, he must be directed to make signatures on the cheques.
With these observations, the petition stands disposed.
